Made to Order / Custom Order Terms and Conditions:
By consenting to the terms and conditions you hereby understand that the items you are
ordering are made to order items that are created in our warehouse specifically for your
order. These items take time to create, and are typically completed between 1-2 weeks
after your order is placed (sometimes sooner). Once your order is placed, we do not
allow alterations to sizing, material or images, nor do we permit refunds to be given in
the event that these terms were overlooked and blindly agreed to. If you receive a
custom/made to order item from us that is incorrect you may contact our support team
with your order number in the subject line and they will be happy to assist you in an
exchange for the correct items originally ordered. We do not allow refunds due to
impatience or in the event of unforeseen circumstances, e.g., “my boyfriend and I broke
up and I don’t need these anymore,” “I didn’t know they’d take two weeks to create,” “I
need the money to pay bills,” “my mom won’t let me have it anymore,” and so on.

What if an item is defective or is not what I ordered?
In the rare case that your shipment contains a defective item or we accidentally sent
you the wrong item, we will ship you a replacement at no charge and credit the cost of
your return shipping charges once your return is received. If you don't wish to receive a
replacement item, we will gladly refund your return shipping cost in the form of a store
credit if you would like to return the item. Subject to the following: If UPS ground or
FedEx ground is used, full amount will be reimbursed. If Overnight, Priority, 2-day, or 3-
day services is used, only the amount UPS ground would have charged for the same
return will be refunded to you in the form of store credit not the actual amount you
spent. Please include all original packaging and attach a brief note explaining the
defect, or indicate on your receipt the item shipped in error.
What is the Processing Time?
All orders are processed, verified, and shipped within 2-4 business days or sooner.
Express orders are processed within 1 business day.
We are not responsible for orders lost in the mail, incorrectly supplied addresses, or
unclaimed/refused packages or stolen packages.
You can track your package using the supplied tracking number.
*Please Note: The time it takes to receive items includes Processing + Shipping Transit
time. For example, choosing a Next Day Shipping service does not guarantee you will
receive it the day after you place your order.

EXPECT SHIPPING DELAYS
Due to COVID-19, carriers (USPS & FEDEX) are experiencing increased delivery times
+ lags on tracking. If your order hasn’t moved in over a few days or is late, we
recommend reaching out to the carrier directly for an update. Unfortunately, we will be
unable to issue you a refund for the shipping fee.
Upon placing an order that contains multiple items plus any made to order items, your
order may be split into multiple shipments to get you your products as soon as possible.
Some products made in our facility take longer than others and upon completion will
ship immediately. Do not be surprised if you receive your items from your order
individually. If you have any concerns about the whereabouts of your unfulfilled times on
your order than feel free to contact us via email.

Shipping is automatically calculated prior to submitting your payment information.

How do I track my order?
When your order has shipped, we will send you a confirmation email that includes your
tracking number so that you can follow the progress of your shipment. For international
orders, Standard Airmail includes a customs form label number that can be used to
locate your package, but is not an actual tracking number.
What are Custom Fees?
A customs duty is a tariff or tax on the importation of goods. Commercial goods not yet
cleared through customs are held in a customs area, often called a bonded store, until
processed.
All applicable custom fees, taxes and duties are the sole responsibility of the customer.
Custom authorities require that we state the value of your order directly on your
package. It is at the sole discretion of custom agents to release your package.
Note, in rare occasions custom agents may delay delivery of some packages.
As far as customs charges, we do not have any control over them, nor know what the
charges will be, if any. If your package is being held by customs, that means you need
to pay the custom fees in order to retrieve your package. If you don't, the package will
be returned to us.
Returns and Exchanges:

Unfortunately, we cannot and do not accept returns or exchanges on made to order
items due to customer error. Once a product is mailed out, we have to assume that it
has been worn for the protection of other customers.
Additionally, we do not give refunds for orders canceled due to impatience or incorrect
orders attributed to customer error. Please double check to make sure your order is
correct before submitting payment! We will not provide a cash refund on custom orders.
Please make sure you select the correct size/design prior to completing your order.
RETURNS FOR STORE CREDITS MUST MEET THESE REQUIREMENTS:
Merchandise must be returned within 5 business days of receipt.
Merchandise must be unworn and unwashed. We cannot accept returns of items that
have been damaged, worn, or soiled, and clothing tags must still be intact. Items must
be in a condition suitable for resale.
Merchandise must have all tags, including any hangtags attached.
Any merchandise marked "Final Sale" or “Made to Order” cannot be returned.

Shipping fees are not refundable.
Playamade Clothing, LLC ™ diligently inspects all items before shipping; therefore,
damaged merchandise is extremely unlikely. Any returned items will be inspected for
signs of wear or smoke, and in the event that the item does not match the original
condition, the buyer will not receive a store credit.

RETURN PROCESSING TIME
Upon receipt of your package, your return for a store credit will be processed within 3-4
business days. You will be notified via email once your return has been processed.
WHEN MAKING AN RETURN:
Pack your merchandise securely in the original product packaging, if possible. Please
note that all items must be returned in original condition (including all paperwork, parts
& accessories) with tags attached.
Be sure to include your original invoice with your return. You may want to keep a copy
for your records. If you can't send the invoice, just include your order number, billing
name & address, and reason on a piece of paper with your return.
Write “Reason for Return” on the back of your invoice.
Keep the return tracking number for your return package to monitor delivery status. We

4. INFORMATION DISCLOSURE. We may share your Personal Data with, or disclose your
Personal Data to, the following categories of third parties. We will only share such
Personal Data with third parties that are our service providers and do not sell your
personal information to any third parties within the meaning under the CCPA:
A. Parent companies, subsidiaries, and affiliates. We may share your Personal Data with
our parent companies, subsidiaries, and/or affiliates for purposes consistent with this Privacy
Policy. Our parent companies, subsidiaries, and affiliates will be bound to maintain that
Personal Data in accordance with this Privacy Policy.
B. Agents, consultants, and service providers. We may share your Personal Data with our
contractors and service providers who process Personal Data on behalf of Playamade
Clothing, LLC ™ (as our “agents”) to perform certain business-related functions. These
companies may include our marketing agencies, database service providers, backup and
disaster recovery service providers, email service providers, and others. When we engage
another company to perform such functions, we may provide them with such Personal Data
as your name, contact information, customer demographic profile and interests, purchase
history, content of your queries and personalized products and our platform browsing
information, in connection with their performance of specific functions.
C. Business transfers. As we develop our business, we might sell or buy businesses or
assets. In the event of a corporate sale, merger, reorganization, dissolution, or similar event,
Personal Data may be part of the transferred assets. You acknowledge and agree that any
successor to or acquirer of Playamade Clothing, LLC ™ (or our assets) will continue to have the
right to use your Personal Data and other information in accordance with the terms of this
Privacy Policy.
D. Wishlist. If you create a “wishlist” on the Site, it will be publicly accessible to any other
users who enter your account-related email address in the “View Friend’s Wishlist” search
box. If you do not want someone to access your wishlist, do not share your Account-related
email address with them.
E. Aggregated or de-identified data. We may disclose aggregated or de-identified
information for any purpose. For example, we may share aggregated or de-identified
information with prospects or partners for business or research purposes. Once Personal Data
is in an aggregated form, for purposes of this Privacy Policy, it becomes Non-Personal Data.
F. Legal requirements. We may disclose your Personal Data if required to do so by law in
order to, for example, respond to a subpoena or request from law enforcement, a court or a
government agency (including in response to public authorities to meet national security or
law enforcement requirements), or in the good faith belief that such action is necessary to (i)
comply with a legal obligation, (ii) protect or defend our rights, interests or property or that
of third parties, (iii) prevent or investigate possible wrongdoing in connection with the Sites,
(iv) act in urgent circumstances to protect the personal safety of users of the Sites or the
public, or (v) protect against legal liability.
G. We remain liable for the processing of your personal data when transferred onwards
to a third party who acts as an agent on our behalf (including our contractors and service
providers), including where that agent acts contrary to Privacy Shield Principles and/or the
GDPR.
H. In order to ensure the compliance of third parties with the Privacy Shield Principles,
GDPR and CCPA, we require our contractors and service providers to commit to respecting a
similar level of the protection of personal data to that under the Privacy Shield Principles,
GDPR or CCPA in their contracts with us. We make sure that our third parties that are
contractors and service providers are subject to confidentiality agreements and are handling
your Personal Data solely under our instructions. With our contractors and service providers,
we enter into a contract that describes the purpose and requires the recipient to both keep
that personal information confidential and not use it for any purpose except for the purposes
specified above.
I. We will never transfer your personal data to any companies other than those and for
the purposes listed in this section.
5. PRIVACY SHIELD. Where you are an EEA individual, we may transfer your personal data
outside the European Economic Area (EEA), including from the EU and Switzerland, to
EC’s offices and servers in the USA.

use, and retention of personal information transferred from the European Union and

Department of Commerce that it adheres to the Privacy Shield Principles. If there is
any conflict between the terms in this privacy policy and the Privacy Shield Principles,

6. INFORMATION SECURITY MEASURES. We have implemented appropriate
organizational, technical, and administrative measures to protect Personal Data within
our organization, including security controls to prevent unauthorized access to our
systems. We also exercise care in facilitating the transmission of information between
your device or computer and the third-party servers that operate and store
information for the Site. Where necessary, we also enter into agreements with any
third-party providers involved in hosting or storing personal data to ensure they meet
similar security standards.
While we take reasonable steps to secure your Personal Data from loss, misuse,
interference and unauthorized access, modification, and disclosure, you should be

7. CHILDREN’S PRIVACY.
A. This Site is not Intended for use by Children. Playamade Clothing, LLC ™ is committed
to protecting the privacy and safety of children. This Site is a general audience site and
children under the age of 13 in the US and below 16 years in the EU and Switzerland are
prohibited from using or registering for an Account on the Site. We will not knowingly collect
any information from children; nor will we send any email correspondence to them. We may
ask for your birth date during the registration process in order to verify your age. If we learn
that we have collected information from a child under the age of 13 or 16 where appropriate,
we will remove that information immediately and delete it from our servers. Children under
the age of 13 or 16 should always ask their parents or guardians before providing their

B. California Minors. We may provide Site users the ability to publicly post information,
for example by submitting user testimonials or other User Content. If you are a California

information or User Content you want removed and provide us with specific information,
such as the URL for each page where the information is located, so that we can find it. We are
not required to remove any User Content or information that: (1) federal or state law

by you; (3) we anonymize the User Content or information so that you cannot be identified;
(4) you don’t follow our instructions for removing or requesting removal; or (5) you received
compensation or other consideration for providing the User Content or information. Removal
of your user content or information from this Site does not ensure complete or
comprehensive removal from our systems or those of our service providers. We are not
required to delete the User Content or information posted by you; our obligations under
California law are satisfied so long as we anonymize the User Content or information or

believe the change would violate any law or legal requirement or cause the

Data except by also deleting your user account.

If you opt-out, you will continue to receive service-related emails. Any non-service
related email you receive from us will include an unsubscribe link that will allow you to
opt-out of receiving future emails. Please note that it may take up to forty-eight (48)
hours for us to process an unsubscribe request. Even after you opt out of all electronic
communications, we will retain your Personal Data in accordance with this Privacy
Policy, although we will no longer use it to contact you.

LLC ™ commits to resolve complaints about our collection or use of your personal
information. EU and Swiss individuals with inquiries or complaints regarding our
Privacy Shield policy should first contact EC at info@playamadeclothing.com if you
have questions about our Privacy Shield compliance. We will respond to your
complaint or inquiry within 45 days of receipt.
EC has further committed to refer unresolved Privacy Shield complaints to JAMS an
alternative dispute resolution provider based in the United States. If you do not
receive timely acknowledgment of your complaint from us, or if we have not
addressed your complaint to your satisfaction, please visit JAMS for more information
or to file a complaint using this link. This service will be provided at no cost to you.
You may have the option to use a binding arbitration mechanism for the resolution of
your complaint under certain circumstances, provided you have a) raised your
compliant directly with Playamade Clothing, LLC ™ and provided us the opportunity to
resolve the issue; b) made use of the independent dispute resolution mechanism(s)
above; c) and raised the issue through your relevant data protection authority and
allowed the Department of Commerce an opportunity to resolve the complaint at no
cost to you. The binding arbitration will be handled by the International Centre for
Dispute Resolution’s American Arbitration Association, available here.
Playamade Clothing, LLC ™ is also subject to the jurisdiction of the Federal Trade
Commission (FTC) and the Department of Commerce in the United States. In relation
to a Privacy Shield complaint, you can make your complaint directly with the Federal
Trade Commission and Department of Commerce regardless of whether you are a US,
EU or Swiss individual.
